I think so, but the answer is not clear cut. Under Federal Rule of Evidence 404(b)(2), evidence of other bad acts (here, the BS attempts to indict James) can be admitted into evidence to prove, among other things, a common scheme or plan.

Well, it can get complicated, as I said, but the basic rule would be that the states can't tell the federal government how to run its own operations.

Only for state and local LEO's. It's a little more complicated than this (always is), but basically a state cannot regulate how the federal government operates.

Both are great. I think the choice boils down to how you're trying to position the book. The first feels more "literary" to me while the second more core genre.
