The Civil Service contracts of employment
did not indicate that the parties regarded check-off arrangements (deduction of union subs from salary)
as unenforceable. So PCS could claim under the Contracts (Rights of Third Parties) Act 1999.

Another point is that the only proposed justification for permissible fire/rehire is financial which sits uneasily with discrimination justification in which cost alone is almost never allowed.
