What do you propose that the president can unilaterally do to reform the courts?

The president won't be able to do anything involving court reform without at least a majority in both houses.

It goes to intent, so it's both useful and appropriate to take judicial notice. Especially if the government filing claims a neutral reason for the RIF. Citing those comments justifies a departure from the normal presumption of regularity.
