Fifth Amendment: Protects against deprivation of life, liberty, or property without due process of law. Sending an American to a foreign prison without proper legal proceedings will violate this right. Sixth Amendment: Guarantees the right to a fair trial, including the right to be informed of the charges, to confront witnesses, and to have legal counsel. If an American is imprisoned abroad without these rights being upheld, it will be seen as a violation. Eighth Amendment: Prohibits cruel and unusual punishment.
