The case wasn't weak, it was just one of the weaker (or more technical) cases to bring against Trump during that limited window of vulnerability. Also, lawyers being AG is, of course, appreciate. It's the AG-as-pipeline-to-higher-office that's the problem

In PA, an individual who fails to provide a breathalyzer sample after arrest is subject to civil penalties (license suspension). 75 PaCS 1547(b). The officers also have to read warnings and have the motorist sign a form. A quick Google search indicates TX's implied consent law works the same.

It seems that the review is limited to whether the arbitration decision is consistent with EU public policy. So, if the sports organizations apply their own rules wrong, but not in a way that conflicts with public policy, the courts won't do anything. That's how I read it, at least
