HAPPENING NOW: Judge McConnell is sharply rebuking the Trump administration for what he said was defying his order to make full SNAP payments by Nov. 5. He has ordered USDA to make the *full* payment to states by tomorrow.

Hi🖐️ -- we're still here in the cavernous, windowless courtroom in the federal building hearing arguments about whether Colorado ICE officers are illegally taking immigrants into custody and detention without assessing their flight risk.

My latest: First day of arguments in a case challenging ICE officers in Colorado and their lack of warrants in detaining non-criminal immigrants. We'll pick up at 9 am tomorrow.

Federal judge hears arguments that Colorado ICE agents are illegally detaining people
Plaintiffs' lawyers argued that Colorado-based immigration agents do not first assess the likelihood of fleeing, which is required by federal law.

"We’re going to send a message to every Denver police officer that your employer is hanging them out to dry. We’re going to come after their personal assets, their cars, their marital estates, we’ll garnish their wages."

Where does $20 million come from? Massive jury award will test George Floyd-era police reform law in higher courts
The law attempts to hold cities and officers accountable for egregious mistakes on the job — and lawyers are trying to outsmart it.

ICYM: @cprmarkus.bsky.social and I finished this piece last week and it landed Friday amid a busy news day. We could find no evidence that ICE's claims that assaults on their agents have gone up 1,000 percent nationally. Or in Colorado.

Claims of huge rise in assaults against ICE drive responses, but aren’t seen in available data
Despite repeated requests from CPR News for data to support the assault claims — ICE and Homeland Security have produced nothing but a handful of anecdotes.

House Republicans demand health care and Medicaid data from Colorado
Specifically, they’re demanding lists and information about costs associated with operations and medical procedures done on people unauthorized to be in the country.

So the feds had a press conference today announcing they cracked down on the Venezuelan gang TdA. But then none of the actual charges are tied to gangs, RICO or gang affiliations.

Feds announce drug and gun charges, then make gang claims they won’t have to prove
Monday’s press conference was a repackaging of months of arrest warrants, indictments and superseding indictments as the number of defendants grew.

Could tracking denied gun sales help prevent tragedies? Experts think so
Gun purchase denials — which are immediately reported to local law enforcement, federal immigration officials and some prosecutors — could be useful intelligence. But is anyone making use of the data?

State AG Phil Weiser both sues an individual sheriff's deputy for sharing information about a woman he stopped with ICE and launches a patterns and practices investigation on 4 law enforcement agencies on whether they're purposefully breaking state law on information sharing with ICE.
