You absolutely do not have to hand it to him, etc., but Summers called his friendship with Epstein a "major error in judgment" and that he has "great regrets"

figuring out how he got here is harder than any puzzle i've ever tried

I was asked the other day about how LLMs will impact my job as a lawyer in the future. I responded that, putting aside everything else, using it would make my briefs worse because it would deprive me of the opportunity to clarify my thinking through the writing process

He's not saying that dicking around is a bad thing lol

States definitely should ban gps services suggesting ETAs that require speeding. I assume they personalize based on user history or at least suggest based on average flow (which can be above the speed limit)
December 14, 2025 at 12:42 AM
I also find it funny that showing a frowning emoji to speeders results in a statistically measurable reduction in average speed and number of speeders
December 13, 2025 at 9:57 PM
I agree that this will never work here but I found it interesting in New Zealand that they have very high speed limits on windy roads that require you to drive far under the limit to remain safe. I think their traffic-related death rate is half that of the US

The Civil Rights Act (which still is the law of the land!) grants her co-workers the right to work in a non-racist environment!

If Kd3, Ne5, bishop can't take because of rook. If Kf3, Ne5, white bishop also provides check

If Kf5, Nd4. If Kf3 or Kd3, then Ne5. If black pawn takes f4, then Nb4. If black moves bishop, Ne7. I think that's all the scenarios

Can't you just exempt spousal ESOP/ESPP stocks from the ban?

A misrepresentation of the editorial, which is mostly about why we don't generally make public investigational documents. I don't agree with the editorial

The anti-Erie stuff is wacky but I am sympathetic to the argument that certification is overused. I had a judge certify a question sua sponte on an issue where other federal courts in the district had previously applied state law without any confusion maybe a half-dozen times
November 20, 2025 at 9:09 PM
Based on this, he believes that federal courts are equally capable of deciding state law issues (still applying the law of the forum state). Consequently, he thinks federal courts should be less inclined to certify state law questions to state court.
November 20, 2025 at 8:08 PM
Under Erie (which Oldham dislikes but accepts is the law), federal courts are required to apply the law of the state, including state law rules on statutory interpretation. He argues that the grant of diversity jurisdiction to district courts includes the authority to decide state law claims.
November 20, 2025 at 8:08 PM
That is not what he's arguing. He's arguing that the grant of diversity jurisdiction includes the grant of authority to decide state law claims, so federal courts should be less inclined to kick state law issues over to state courts.

Trump said MBS "had nothing to do with it" yesterday so I think it's pretty clear that the "he" is MBS

Man only has one line. The market "is not a Disney version of a market, but an actual working farmers market." One wonders if he ever goes to any farmers markets around the state.

Keep Pike Place Market open to traffic
Pike Place Market is the one place everyone can feel safe and enjoy. The flow of trucks, cars and people keep the market lively during the day and night.
