The lowest common denominator is what? The human condition. Education level, engagement (arousal state), and propensity for hair-trigger provocation...? Everyone has each in degrees. And Fox News and MSNBC are more "exciting" than C-SPAN.

Nah, you're overthinking it. Easier to turn "right" when you're already on the right. They were cosplaying as social progressives but have very little training and background for it. Or temperament.

Can (should?) President Biden make recess appointments to the open judgeships in late Dec/ early January? I assume Biden would not be bound by any Senate deal mentioned in the article. Do norms and precedents even matter? @jacklgoldsmith.bsky.social, we welcome your thoughts...
