The result in Taylor, as Sotomayor puts it, “strikes at the core premise of public schools”—that children of all faiths and backgrounds come together to learn about a “range of concepts and views that reflect our entire society.” It is the product of a conservative supermajority whose members think of the Constitution as a compact that applies not to all Americans, but to people who look like them: wealthy, conservative Christian lawyers who do not interact with anyone other than wealthy, conservative Christian lawyers, outside of occasionally tipping a caddy at the Congressional. For them, the First Amendment does not guarantee freedom of religion. It protects their power to privilege their religion over the religions of everyone else.

In a Feb. 28 memo, the agency said it “will no longer exempt” from deportation people in groups that had received more grace in the past. This includes the families of military personnel or veterans, Stock said. As of June 12, the agency said it has referred upward of 26,000 cases to ICE for deportation.

I have considered your arguments and find them to be full of shit. The policies you hate—like affirmative action, the Voting Rights Act, and “DEI”—are not there to help black people; they’re there to stop white people from being so racist. You might say that the law cannot change the hearts and minds of white folks, but changing minds has never been the goal of these laws. We do not require white folks to believe in or commit to racial equality and social justice in this country; we need them to keep their boots off of our necks. Whenever white people leave us the hell alone, we thrive.

I remember being pretty frustrated about this during the first year of Covid vaccination, when liberals were outraged about the relatively low rates of vaccination among conservatives. I kept thinking to myself, yes, there is some Cost to society of lower vaccination rates leading to increasing disease prevalence, pressure on hospitals and need to reimpose social 'estrictions. But at a disease level, the person refusing the shot is also the person shouldering a much larger share of risk SO much larger than the additional risk he or she is mposing on the community.

Wallace-Wells: I see the math here a little bit differently, because I don’t think the real purpose of vaccination is to achieve herd immunity, however much “pro-science” liberals like to talk about that. I see the main purpose as lowering your child’s risk of serious illness. We may talk about vaccination trade-offs in these terms — personal risk versus social benefit — because given widespread vaccination, the additional risk to your child may be relatively small. But the much more significant impact of a shot is on the person getting the shot, not on the rest of his or her nursery school, right?

I think people are asking the wrong question, and giving the wrong answer. The government can do this because the government has what scholars call a “monopoly of force,” meaning the government can violently attack people but the people are not legally allowed to violently fight back. This government can use its monopoly of force in this way because the American people elected a fascist dictator to rule over them. That dictator, Donald Trump, promised to do exactly what he is doing. The warrant for Khalil’s abduction was signed on November 5, 2024, by over 77 million people who voted for fascism, and 90 million eligible voters who couldn’t bring themselves to vote against fascism. The government can do this because this is what people who support Trump want the government to do.

Trump’s assault on basic First Amendment principles may begin with Khalil, but it will not end with him. Trump’s ultimate target is anyone he finds useful to target. Trump and his advisers simply hope the public is foolish or shortsighted enough to believe that if they are not criminals, or deviants, or terrorists, or foreigners, or traitors, then they have no reason to worry. Eventually no one will have any rights that the state need respect, because the public will have sacrificed them in the name of punishing people it was told did not deserve them. The Trump administration began its drive for absolute power by ignoring congressional appropriations of foreign aid, which are laws. It calculated that Americans would be callous enough not to care about the catastrophic loss of human life abroad and that the absence of backlash would enable the administration to set a precedent for defying duly passed laws without consequence. Trump began his assault on antidiscrimination law with a vicious campaign against trans people—but has already broadened that campaign into a sweeping attempt at a great resegregation of American life. The detention of Mahmoud Khalil begins a dangerous new phase, in which the Trump administration will attempt to assert an authority to deprive people of due process based on their political views.

The most simple, clean, easy, and morally correct way out of this mess would be for Eric Adams to resign. The city, state, and country would all be better off if Adams would just… self-deport. I hear Istanbul is lovely this time of year, and I’m sure Adams’s new friends in the Trump administration could find him somebody to pay him all the free air miles he could want in exchange for wearing a “Blacks 4 Trump” T-shirt every time he’s near a television camera. Give Adams to Harlan Crow so he can add another Black guy to his collection.

There are only two ways to deal with this Supreme Court: ignore its rulings or flood it with new justices who will give back the power this court has stolen from the rest of us. The first option, most likely, leads directly to civil war—one where the rule of law can be imposed only by military force under the sole discretion of whoever happens to be the president, assuming that president commands the loyalty of the military. Democracy cannot long exist if laws have meaning only when the president decides to enforce them at the point of a gun. The second option, court expansion, is the normal, peaceful, constitutional solution to a court that no longer believes it can be checked by other institutions. Adding justices who are going to act within the bounds of their constitutional authority is the only peaceful way to save ourselves from the ones who won’t. I support court expansion because it is the simple, legal, and nonviolent way to counteract the corrupt and power-hungry court.

When patients use those cards at pharmacies, the pharmacy is charged a fee by the PBM. They don’t reimburse pharmacists for filling the prescription because it’s not considered “a typical insurance transaction.” “As a result, pharmacies often lose money on discount card transactions,’ the lawsuit says. And the partnerships with GoodRx and PBMs “stand to drastically increase the number of prescriptions processed through discount cards,” the lawsuit states. The discount card system allows PBMs to “minimize” what they pay in insurance reimbursements “and maximize the fees they collect from pharmacies,” according to the lawsuit. Pharmacies can’t opt out of taking discount cards either because PBMs have made them a requirement to stay in their network, the suit says.

Pharmacists also aren’t allowed to tell their patients why any of this is happening, said Giles. PBMs prohibit pharmacists from telling patients that the cost of their prescription isn’t fully covered — a contractual gag clause that will kick pharmacies out of network if broken, according to the state pharmacy association. Beyond just lower reimbursement rates, the lawsuit alleges that PBMs and GoodRx have created a “thinly veiled price-fixing conspiracy with the intent and effect of reducing competition for pharmacies.”

In recent years PBMs have not reimbursed pharmacies enough to cover the cost of medications or their overhead expenses like rent and utilities, according to the lawsuit and the Alabama Pharmacy Association. For pharmacists, that means they can’t stock certain drugs that cost a lot of money, like those for diabetes, weight loss, or blood thinners, said Giles. It also often means that the more prescriptions they fill, the more they are operating at a loss. “Our goal is to fill your prescription, but the only way we’re going to be able to continue to serve most of our patients is by denying some,” said Giles. “There are life-sustaining drugs that are not stocked by pharmacists because they cannot afford to fill it.”
