Highlights below!
5.A.ii.a Deceptive and misleading, as written. Dangerously so, even. ("Depicts" and "simulates" do a lot of heavy lifting/CYA here, for an assertion about the law that would otherwise be either an embarrassing misunderstanding of the law on T&S's part, or an outright lie.) If you want to continue to prohibit loli and shota, it is your platform on which to do so. If you fear that you must, to avoid obscenity-related legal risk in your country of incorporation, I defer to your legal counsel. But to draw parallels the way you have done here, between this fictional content - however distasteful you may find it - and actual evidence of real harm, being committed against real people - is an insult to the experiences of actual survivors of child sexual abuse, and a grave harassment hazard against artists, fans, role-players, and survivors who, for whatever reason, partake in such fictional content, even if it remains entirely off-site, and beyond the scope of your authority. The average person reading this rule *will* mistake your words for a claim that "illustrated or animated sexual depictions=CSAM". It's not true - not per US law, at least - but if the average person believes it, you will inspire harassment and bullying against NSFW artists who work with taboo subject matter. Possibly to the point of vigilante violence. 5.A.i.b This rule only makes sense for actual sex crimes being committed in real life, on camera (assault while sleeping, revenge porn, etc. IOW, realistic, non-fictional content) Yet another case in which imposing this rule upon fictional content would unnecessarily censor artists of taboo content. Is an artist's having drawn a picture of a somnophilia scene sufficient evidence that the artist consented to produce it? Or is this artist now in trouble because the fictional character doesn't appear to have consented to sex because they were drawn sleeping? If I draw one of my own OCs having sex with me while I sleep, am I in trouble because I "violated" myself, according to this rule? 5.A.ii.b Again, does this solely prohibit live-action content featuring animals? (A reasonable measure to deter very harmful, highly illegal treatment of real animals?) Or is this rule also arguing that obviously fictional illustrations are forbidden because they "glorify" such activity? Are women at risk of being suspended if they're into monsters and fantasy creatures, such as werewolves or dragons? Can users be suspended for showing off sex toys and dildos that resemble non-human genitalia? What of Pokemon? Are scenes featuring Pokemon considered "glorifying" of bestiality? And what about furries? Are furries considered animals? With this rule in effect, how would you guarantee that this rule would never, at some point in the future, be used to purge furries from Bluesky? 5.A.ii.c Are you really committed to deterring true hotbeds of predatory activity? Such as links to Roblox? Minecraft? Discord? Facebook?? Or will this instead be used as an excuse to target artists that reside on more permissive platforms such as the Fediverse? Will Japanese artists have to fear another ban wave if anything in their profiles links back to a Pixiv page? One last thing for point III: In my experience as an artist, you have to go to very, *very* great lengths in order to "glorify" or "promote" a bad real-life thing in a drawing. You have to be conscious and intentional, to do this. You have to be extremely egregious and overt about the bad thing, to the point of absurdity. It is not possible to witness an artist merely depict a bad thing happening in a drawing, and on that basis alone conclude that the artist must want to do the bad thing in real life. You can't draw that conclusion even if the artist enjoys the fantasy. I therefore argue that no fictional content, absent further information, deserves to be considered as "promoting" or "glorifying" any of the things that these guidelines would accuse it of endorsing. Your artist would have to regularly and unambiguously state their desire to do the bad things in real life, weaving their intentions into every verbal interaction that accompanies their art posting, in order to conclude that. And the guidelines need to reflect this attitude.
