That instruction upheld a key principle from Brandenburg v. Ohio:
Speech can only be punished when it is directed and likely to produce imminent lawless action.

“Mere advocacy,” however offensive, remains protected.

Judge Anthony Trenga instructed the jury that “speech that merely, without more, encourages or advocates that others should engage in violence—even against political figures—at some indefinite point in the future” is protected by the First Amendment.
