Long ago, I remarked that the rule of law protects us from risks that the existence of the law creates. The law is used to secure various valuable conditions, whose nature varies with circumstances and with the views of those in power. The rule of law does not directly contribute to success in achieving them. But, while the law can be used to achieve much that is good, its existence also creates opportunities for much evil. We all know that. The law is a powerful structure, and those who control it have power, which, like all power, can be abused. The rule of law helps to protect us from some of those risks.

John Gardner on the asymmetrical interpretation of the rule of law:
The rule of law entails, in other words, an unequal struggle between officialdom and the rest of us. It places burdens on the law and on its officials that it does not place on ordinary folk. We need not be on the right side of the law ourselves to be able to insist, under the heading of the rule of law, that the law and its administrators and enforcers stay on the right side of the law, and indeed give us every assistance in using the law against them when they do not. They, on the other hand, promptly jeopardize their moral standing to use the law against us every time their handling of the situation slips below the standards that the rule of law sets, including when they resort to illegality in their own actions. I will call this the ‘asymmetrical interpretation’ of the ideal of the rule of law. It has the implication that judges and other officials are often morally bound to uphold the law in their dealings with us (including, for example, in punishing us for its breach) even though, as they well know, we were not and are not morally bound by the same law ourselves. Some people find this implication uncomfortable. I, on the other hand, regard it as an independently attractive conclusion, and count the yielding of it as a point in favour of the asymmetrical interpretation.

Research in psychology provides us with ample evidence on human limitations in interpreting history. Human observers tend to over-attribute historical events to human intention. If something happens, someone must have wanted it to happen. Humans tend to interpret history as a set of necessary outcomes, rather than as draws from a distribution of possible outcomes. It is hard for them to treat events that actually occur as having a probability, possibly a rather low probability, rather than being necessary outcomes. Human observers use very simple rules for interpreting history. They believe, for example, that big effects must have big causes, although most of our research teaches us that many big effects are actually produced by small causes amplified through positive feed-back loops. They believe that causes will be found in the neighborhood of their effects, although our research tells us that effects often have remote causes.

Pay inequality stems both from differences in workers’ individual characteristics and firm pay setting. Some firms capture more value or pass on a larger share of surplus to workers. Yet, intergenerational mobility research focuses on transmission of individual traits, neglecting how firms shape the inheritance of inequality. We use three decades of Swedish administrative data to decompose the intergenerational earnings correlation into firm pay premiums and worker effects. One quarter of the intergenerational earnings correlation at midlife is explained by sorting between firms with unequal pay. Employer inheritance accounts for a small share of this firm-based earnings transmission. Instead, high-education and high-occupation workers disproportionately work at high-paying firms. Parental referral networks and the inheritance of industry and labor market context play a supplementary role. As workers with high-education or high-status jobs increasingly benefit from high-paying firms, firm premiums constitute a central mechanism through which collective processes drive intergenerational earnings transmission.
