I gotta say something. I do civil rights work every day. In Florida. It’s demoralizing enough most days. I get the impulse for reactions like this but man, it really does a number on you.

Before the census, advocates urged DeSantis to invest funds to ensure an accurate count. They said failing to do so risked an undercount. Now he and our goofball Attorney General are blaming libs and the deep state for the undercount.

TALLAHASSEE - Months after saying the state would not "have a role" in promoting the 2020 census, Florida Gov. Ron DeSantis reversed himself and announced Monday the state would help after all. Counting every living American is a massive effort, and certain populations - especially renters and people of color - risk not getting counted. The configuration of congressional and state legislative districts, as well as billions of dollars in grant funding for things like school lunches, rely on decennial census data. Officials fret about counting as many people as possible. In June, DeSantis rejected the idea after a Sarasota news conference. A statement issued Monday evening struck a different tone. "Florida will do its part to support the federal government's efforts," DeSantis said in the release. He named Lt. Gov. Jeanette Nuñez to lead the committee. In response to a question about why DeSantis changed his position, his office said Monday that his previous comments were not about the census as a whole. "When the Governor said Florida does not have a role in the census, he was responding to questions about whether citizenship should be included in the questionnaire, which was a question for the federal government," said spokeswoman Helen Aguirre Ferré. But that's not correct. An audio recording of DeSantis' exchange with a reporter after the June news conference confirmed that he wasn't asked about whether citizenship would be on the questionnaire. Instead, DeSantis was, in fact, asked to respond to the request from Democratic lawmakers "to form a census committee to ensure that Floridians aren't miscounted." However, while some other states have pledged millions of dollars to support their state committees' efforts, Monday evening's announcement indicated no state dollars would be used. "The federal government is going to be using a record-breaking amount of money to ensure the duties of the census are being carried out," Ferré said. "We do not anticipate, at this time, adding any monies to that." As of December, the New York Times reported there was a clear partisan gap between states willing to fund campaigns promoting the upcoming census. Democratic-controlled states were. Republican-controlled states weren't. California will spend $187 million, for example, while the Texas Legislature declined any funding. The governor's announcement doesn't give state government much time to enter the census process. Nearly every county already has a local census committee.

Dear City Commissioners: The American Civil Liberties Union (ACLU) of Florida is a nonpartisan organization whose mission is to protect, defend, strengthen, and promote the constitutional rights and liberties of all people in Florida. We write to you regarding Attorney General James Uthmeier's correspondence to the City Commission dated July 2. The Attorney General claims that the Commission's July 30 vote to void the city's existing 287(g) agreement with U.S. Customs and Immigration Enforcement (ICE) violates Florida statute, and refers to the possibility of suspension from office as consequence. But the Attorney General's arguments and threat rely on false premises. First, the Attorney General claims that when a city terminates a 287(g) agreement, the city violates Florida's prohibition on sanctuary policies. But the plain text of these statutes makes no such leap. The relevant statutes are Florida Statute Sections 908.103 and 908.102(6), neither of which are violated when a city voids a 287(g) agreement.' Second, the Attorney General asserts that Key West voiding its 287(g) agreement violates Florida's "best efforts" clause. Again, the plain text of Florida's Statutes does not support this claim. Florida Statute Section 908.104(1) states, "[consistent with all duties created in state and federal law...local law enforcement agencies and any official responsible for directing or supervising such agency shall use best efforts to support the enforcement of federal immigration law..." This statute does not require cities to undertake 287(g) agreements, nor does it prohibit them from voiding such agreements. There are numerous ways that local law enforcement agencies could comply with this obligation without implementing 287(g) agreements. Additionally, Governor DeSantis has no constitutional authority to suspend municipal officers under these circumstances. At best, the Governor and Attorney General are woefully misreading Florida law. At worst, they are deliberately distorting it in order to bully duly local elected officials using the threat of retaliation. To be clear: under Florida law, the City of Key West is not required to enter or maintain a 287(g) agreement with ICE. Florida Statutes require, "The sheriff or the chief correctional officer operating a county detention facility" to enter into a 287(g) agreement with ICE. While the Monroe County Sheriff's Department is required to enter a 287(g) agreement, the City of Key West is not. No state or federal law requires any law enforcement agency to transform its employees into another agency's officers just to participate in an operation. Yet according to the Attorney General's strange logic, any local government entity in Florida could be required to turn over the entirety of its law enforcement resources to federal immigration efforts. This makes no sense, and it is not the law. A free state respects local officials to make choices that make sense for their communities - it does not weaponize the law to punish those who disagree with the political agenda of state officials. We urge you to resist authoritarian threats, and to listen to the constituents who you serve. 287(g) programs transform local law enforcement into immigration agents at significant local cost. They also lead to illegal racial profiling and other civil rights abuses. Local officials fulfill their responsibility by thinking twice before joining these programs. The ACLU of Florida is committed to defending the rule of law and the ideals on which our democracy was built. Should you be suspended from office, we stand ready to pursue all legal avenues to uphold the will of Key West voters. Sincerely, Bacardi L. Jackson Executive Director ACLU of Florida
