*What the administration is actually considering is a treaty of cession with El Salvador that would make the subject land US soil; after that, nobody held there would have actually been deported. But do you think Trump understands the term "Treaty of Cession"?

The UK plans to cede the Chagos Islands to Mauritius via treaty; in 1951 India and France signed a Treaty of Cession. You're right that under such a treaty the US could no longer argue it couldn't produce the prisoner, but the prisoner could no longer argue that he/she had been deported.

The Senate doesn't ratify treaties. But this Senate would certainly approve a resolution of ratification. The treaty of cession would make that part of the prison US soil.

True. But with a treaty of cession, which is what they're actually talking about, transferring a prisoner would be neither a deportation nor an extradition. That would leave a prisoner in El Salvador a lot less to challenge.
