The Senate just gave employers what might be the biggest gift they could give them this holiday season.

Two new Republican Board Members and a new General Counsel means big changes are on the way at the NLRB. 2026 is shaping up to be a big year for labor law.

Appreciate the Courier Journal letting me share some thoughts on what's to come after the UAW's narrow victory in Glendale, KY at the BlueOval SK Battery Plant. This is one the labor law world has been following closely and it's likely to be a while before we know the final (and momentous) outcome.

Last week, Gov. Jared Polis vetoed SB 5, which would have amended Colorado's Labor Peace Act and repealed the state's right-to-work law. Had Polis not vetoed the bill, Colorado would have become only the second state since Michigan to do so in the 21st century.

Following the General Assembly's veto override, some major changes to Kentucky's workplace safety laws come into effect later this year to align KY OSH with federal OSHA’s enforcement standards and time limits.

Another massive decision from the Court of Appeals allowing the removal of Board Members from the NLRB and taking us closer to a Supreme Court showdown concerning the President's authority over federal independent agencies.

Stay tuned.

With a veto override beyond likely, Kentucky becomes an outlier amongst the state-plan states. While other state-plan states, like Indiana, are already closely aligned with federal OSHA, current trends see them moving beyond OSHAs minimum standards and continuing many of the Biden Admin’s policies.
Kentucky Governor Beshear vetoes Chamber of Commerce-backed OSHA Bill that will weaken protections for Kentucky workers.

The Republican-controlled legislature has the votes to over-ride the veto. Then the ball will be in federal OSHA's court.

A big thank you to the The Indiana Lawyer for the chance to share a few thoughts on what this new landscape means for employers, employees, and unions across the country.

Woah. No President has ever removed a sitting NLRB member before.

This is an unprecedented move defeating Board quorum, stymieing its ability to issue any decisions, and setting up a monumental Supreme Court challenge on longstanding removal protections in place for independent federal agencies.
NEW: Trump’s partisan purge of Democratic NLRB officials in the late hours of Monday targeted Wilcox, the first Black woman to serve on the board. General Counsel Jennifer Abruzzo was terminated as well.

For 25 years I’ve thought the Beagle was the state dog of Kentucky because of a coloring book I got from the KY LRC as a kid on how laws are passed in Kentucky.

I’ve now sadly learned that is not the case and I’ve been misled all of these years. Kentucky does not, in fact, have a state dog.

The end of President Biden’s term has also brought the end of the “contract coverage” standard with the Board’s latest decision in the final days of the current administration.
Today, the Board restored the “clear and unmistakable” waiver standard for evaluating employers’ defenses to claims that they unlawfully changed working conditions of union-represented employees without giving the union notice and opportunity to bargain.
