BACKGROUND The Department of Energy proposes to eliminate 10 CFR 1040.73 via the process of direct final rulemaking (DFR). According to the "Dates" section of the proposed rule, this rule will go into effect unless "significant adverse comments" are received by 2025-06-16; it defines such comments as those which raise "serious… issue[s] related to each of the independent grounds for the rule". Under "Signing Authority", the proposed rule says that it is being enacted "[f]or the reasons set forth in the preamble", which appears to refer to the "General Discussion" section. After laying out background, the reason for the rule is given as follows: "Given the general prohibition on discriminatory activities and related penalties, see 10 CFR 1040.71, DOE finds these additional provisions unnecessary and unduly burdensome. It is DOE's policy to give private entities flexibility to comply with the law in the manner they deem most efficient. One-size-fits-all rules are rarely the best option. Accordingly, DOE finds good reason to eliminate this regulatory provision." For context, I also attach a document on Procedures for Noncontroversial and Expedited Rulemaking (accessed from acus.gov), which describes the nature and purpose of DFR, which "generally has been used where an agency believes that the rule is noncontroversial and adverse comments will not be received" (p.1). The public notice process for DFR is intended to provide "the opportunity to challenge the agency's view that the rule is noncontroversial" (p.1). Notably, "if an adverse comment is filed, the rule is withdrawn" (p.1). screenshot of text, reading: MY INTEREST Though my objections would stand on their own merits even if I had no personal investment, I choose here to explain why I find this rule relevant to my life. Like many Americans, I have friends and family members with limited mobility, including those who need to use wheelchairs. And like all Americans, I am not exempt from the possibility of future misfortune that may limit my own mobility. Therefore, any regulation affecting the lives of handicapped people is one that is of personal concern to me. OBJECTIONS I consider the paragraph of justification to be best understood as a single grounds for implementation of the rule. However, for maximum clarity, I will treat each sentence as a separate grounds and state my objection to each, each of which requires "a substantive response" as indicated by the rule's "Dates" section. (a) "Given the general prohibition on discriminatory activities and related penalties, see 10 CFR 1040.71, DOE finds these additional provisions unnecessary and unduly burdensome." Section 1040.71 is a general provision prohibiting denial of benefits, exclusion from participation, or general "discrimination under any program or activity" receiving federal funds. Notably, it does not guarantee general access to building spaces. Therefore, rescinding section 1040.73 would materially harm handicapped people's access to public spaces in ways not compensated for by section 1040.71. New buildings could be constructed to exclude handicapped people as long as no relevant "program or activity" required access to those buildings. (b) "It is DOE's policy to give private entities flexibility to comply with the law in the manner they deem most efficient." My understanding is that the ADA requires new construction to be accessible by handicapped people. Allowing private entities to construct inaccessible spaces would give them flexibility to break the law, not comply with it. screenshot of text, reading: (c) "One-size-fits-all rules are rarely the best option." It is unclear to me what is meant by "one-size-fits-all" here. Every written regulation, by definition, applies a uniform standard to those under its purview. Section 1040.73 seems to me well-balanced, and includes relevant feasibility caveats. As a civil-rights regulation, it appropriately applies to a wide range of entities, while also allowing latitude to avoid requiring the impracticable. It has functioned thus for over three decades. CONCLUSION This is not the sort of uncontroversial rule for which the DFR process is designed. For the reasons stated above, the proposed rule should be scrapped, and longstanding protections for handicapped people should remain in place.
