"For example, immigrants in deportation proceedings have the right to an attorney, to present evidence, and to appeal unfavorable decisions. "

"While immigrants can be removed from the country, they must be given a fair hearing before an immigration judge, with the right to present evidence and legal representation, unless they fall under expedited removal procedures. "

"Explanation:
The 5th and 14th Amendments of the U.S. Constitution guarantee due process and equal protection under the law to all individuals, including immigrants.
This means that immigrants, even those without legal status, cannot be deprived of their rights without proper legal procedures."

"And to clarify...since the current beleaguered administration needs reminding:
"Yes, due process rights do extend to immigrants in the U.S., regardless of their legal status. This means they are entitled to fair and impartial legal proceedings when their life, liberty, or property is at stake. "

"Impact on Citizens and Non-Citizens:

"Substantive Due Process:
This principle limits the government's power to infringe on fundamental rights, even if proper procedures are followed. The Supreme Court has used this to protect rights not explicitly mentioned in the Constitution, such as the right to privacy. "

"Procedural Due Process:
This refers to the fair procedures the government must follow before depriving someone of a protected interest, such as notice, an opportunity for a hearing, and a right to counsel in some cases. "

"Fourteenth Amendment:
This amendment extends the same protection to state governments, ensuring that no state shall deprive any person of life, liberty, or property without due process of law. "

"Elaboration:
Fifth Amendment:
This amendment protects against federal government action, stating that no person shall be deprived of life, liberty, or property without due process of law. "

"This includes both procedural due process, ensuring fair legal processes, and substantive due process, which limits the government's ability to infringe on fundamental rights. "
