There are plenty of games which have distributed server software, check out the tools tab on Steam! And games could use p2p or offline modes instead if they could do it.

Exact specific legal wording would have to be left up to the lawyers and politicians behind implementing the law. Stop Killing Games does not expect every feature in an online game to be preserved.
