Using the Lougheed Doctrine, governments should only invoke the Notwithstanding clause if they have exhausted all other options.

This includes a full-throated, public defense of their law as placing "reasonable limits... as can be demonstrably justified in a free and democratic society" (s1).

Once it's used, it's the slipperiest of slippery slopes.

We can't allow politicians to pick and choose which rights they allow and which they effectively erase with the Clause.

As invoking the Notwithstanding Clause becomes normalized, no one's rights are safe. Left, right, or centre.

David King sat at the Alberta cabinet table as the Minister of Education when the Notwithstanding Clause was discussed as part of the 1982 Constitution patriation project.

He confirms it was never meant to be used the way it's being used by Smith's government now.

What the Alberta government just did should worry all Canadians.

When they legislated striking teachers back to work, they went a step further:

They used the notwithstanding clause.

This is part of a worrying trend.

There are loads (like hundreds) of bots on Facebook and Twitter that show a location outside Canada posting messages in favour of invoking the Notwithstanding Clause.

Their arguments are nonsensical, but I guess it means this is one of the things that bot farm funders are interested in pushing.

This week's events in the Alberta Legislature (invoking the notwithstanding clause and ramming through the bill in one night) are all the proof we need that we can't rely on the moral compass of politicians (or public pressure alone) to limit the use of the Notwithstanding Clause.

The way this clause was used, together with forcing the legislation through in one day, is an existential threat to the right to collective bargaining in Alberta. And with this precedent in place, all across Canada.
