One might nonetheless ask how this inquiry into compliance is able to proceed at all given that the Supreme Court vacated the TRO after the events in question. That Court’s later determination that the TRO suffered from a legal defect, however, does not excuse the Government’s violation. Instead, it is a foundational legal precept that every judicial order “must be obeyed” — no matter how “erroneous” it “may be” — until a court reverses it. Walker v. City of Birmingham, 388 U.S. 307, 314 (1967). If a party chooses to disobey the order — rather than wait for it to be reversed through the judicial process — such disobedience is punishable as contempt, notwithstanding any later-revealed deficiencies in the order. See id. at 314, 320. That foundational “rule of law” answers not just how this compliance inquiry can proceed, but why it must. See id. at 320. The rule “reflects a belief that in the fair administration of justice no man can be judge in his own case,” no matter how “exalted his station” or “righteous his motives.” Id. at 320–21. The Constitution does not tolerate willful disobedience of judicial orders — especially by officials of a coordinate branch who have sworn an oath to uphold it. To permit such officials to freely “annul the judgments of the courts of the United States” would not just “destroy the rights acquired under those judgments”; it would make “a solemn mockery” of “the constitution itself.” United States v. Peters, 9 U.S. (5 Cranch) 115, 136 (1809) (Marshall, C.J.). “So fatal a result must be deprecated by all.” Id.

Thank you for contacting me about Elon Musk. I appreciate hearing from you. Elon Musk, an unelected billionaire, and the so-called Department of Government Efficiency (DOGE) have spread chaos, confusion, disfunction, and fear throughout the federal government… In addition, the Trump administration when they claimed in a February 17, 2025 court filing that Musk is a “special government employee” of the White House with no official role at DOGE, despite all public statements crediting Musk with DOGE’s work. This effort was kicked off by the reckless and illegal firing of Inspectors General (IG) across the U.S. government who are tasked with the crucial job of routing out waste, fraud, and abuse. I am particularly alarmed by the brazen illegal actions to dismantle the U.S. Agency for International Development (USAID)… Without the U.S. providing these funds, adversaries like China, Russia, and Iran will step in to fill the void… None of this has improved efficiency or reduced waste, fraud, and abuse. It is clear that these efforts are instead partly about “traumatizing” federal workers… and partly about Mr. Musk’s personal business interests… I have been outspoken in denouncing the deferred resignation offer Mr. Musk sent to federal employees… I am deeply opposed to the Trump Administration’s efforts to intimidate and bully our federal workforce while lining Musk’s pockets with federal funding and denying Americans access to the services and institutions they rely on. While there is not an overnight magic solution to fix these profound threats to the rule of law, some of the pressure has yielded positive results, and I am relieved that several recent court decisions have pushed back this agenda. But President Trump continues to attack federal workers, and I will not stop fighting to block the Administration’s harmful actions with every legislative tool available. Senator Mark Warner’s response notes that he is “alarmed by reports that Elon Musk and his associates have gained access to U.S. Department of Treasury systems that control payments to millions of American citizens, including Social Security payments, Medicare payments and tax refunds” Senator Warner has also “called on the Committees on Finance and Banking, Housing, and Urban Affairs to immediately hold hearings requiring Treasury Secretary Scott Bessent to explain to the Senate, under oath, exactly what is taking place.” Senator Warner states that “allowing unknown individuals access to the incredibly sensitive payment system of the Treasury Department goes way outside the scope of government efficiency.” He includes a link to video of a February 5th Banking Committee hearing and concludes by stating “You may be assured that I will continue to press the Trump administration for answers to exactly who has access to Treasury systems and exactly what they are doing with that access.”
