Can't think of a time when I have heard a lawyer discussing platform liability use the phrase "the 26 words."

Don't know why they would. Easier to just say "two thirty."

Have you been sent here from another planet to destroy me?
There are countries where hate speech is regulated just like speech in this country. There is no such thing as free speech. Fire in the theater. We could develop a body of Law and model it on those successes

Countries routinely use hate speech laws to punish political dissent and criticism of public officials.
Hate speech is regulated in many countries democracies in the world, and as far as I can tell, it does not impair or impede free speech. Unlike some other kinds of speech, this is not difficult to classify.

It’s happening.

It doesn’t need to be this way.

The fourth edition of Cybersecurity Law will be published on Oct. 14! A new chapter on Internet of Things, along with many new sections on topics such as CIRCIA, the SEC cybersecurity regs, geofence warrants, and the impact of Van Buren on CFAA litigation.

It always comes back to the crowded theater.

So this is concerning, especially because last year SCOTUS denied cert in a case challenging the constitutionality of criminal defamation laws. www.foxnews.com/us/proposed-...
Proposed Idaho state law could make some lies a felony crime with prison time
Idaho House Speaker Mike Moyle introduced a bill to make it a felony crime to knowingly spread malicious lies about someone.

So this happened last night.

Pretty amazing that 60 Minutes does an entire segment about Germany prosecuting people for online posts and does not include even one voice raising free speech concerns. The segment looks like it was produced by the German government. www.cbsnews.com/news/policin...
Posting hateful speech online could lead to police raiding your home in this European country
In the U.S., most of what we say online, even if it's hate filled, is protected by the First Amendment as free speech. But in Germany, prosecutors and cops police the internet.

Unlike CJEU, SCOTUS is at least supposed to try to apply the First Amendment.

This opinion gives a roadmap for any future court to accept national security or privacy as a pretext for laws and actions that are intended to limit speech (as the bill’s supporters readily admitted).

Who knows if TikTok will remain back
online or who will own it in the long run. But Friday’s Supreme Court opinion will cause enduring damage to the First Amendment.

Still amazed that SCOTUS didn’t even try to hide the censorship motivation.

You realize that you are saying this on social media?

This free speech mess was brought to you by all three branches of government. Great job, guys.

I do not think that tomorrow’s likely shutdown of TikTok will affect the company’s decision to seek cert. This is a liability for TikTok regardless of the app’s future in the US.

There is another important TikTok case at SCOTUS. TikTok likely will file a cert petition in Anderson v. TikTok, a Third Circuit opinion that narrowly construed Section 230. TikTok has retained Paul Clement and received an extension to file until Feb. 20.

Breyer’s latest HLR article reminds me why I am thankful for the writing styles of Kagan and Barrett.

Someone should write a book about why this is wrong.
Anyhoo, he kicks it off with a very bad misunderstanding of the 1st Amendment and the whole "fire in a crowded theater" thing. cc: @kenwhite.bsky.social @jkosseff.bsky.social

Not only is this wrong, it's meaningless. He runs a private platform and isn't Congress. Does he not have ANY 1A lawyers?
