One of the errors that has emerged in recent years in the fetishising of "freedom of contract" and a failure to understand its conceptual (not policy) limits.

The evisceration of the penalties doctrine is one example of many.

The Supreme Court really ought to have spiked this kind of practice in ParkingEye. Their failure to do so, and the resulting misery inflicted, rather outweighs their twee “what we do for the public” boards about proprietary estoppel etc.
