CDT Europe is releasing its first report on how the EU’s current approach to spyware is failing to protect democracy. Spyware is being used across the Union to target journalists, activists, political opponents and public officials. The risks keep escalating. 🧵
📢 ✍🏻 Today, with a group of 60 CSOs and experts, we signed an open letter by @accessnow.org and EDRi, to urge the EU to reject the deletion of the AI Act’s Article 49(2) transparency safeguard for high-risk #AI systems, proposed in the recent AI Omnibus.

Happy (?) European Data Protection Day!

10 years after its adoption, the GDPR remains the backbone of the EU’s digital rulebook. But the proposed Digital Omnibus risks weakening its very core: the definition of personal data.

🛑 To co-legislators: Hold the line on the GDPR.

• Increase capacity in national authorities and expand independent oversight
• Improve information-sharing and align procedures to limit forum shopping
• Lead international coordination to curb global spyware proliferation

• Introduce controls on intra-EU movement of spyware
• Require transparent, disaggregated reporting
• Mandate stronger due diligence and human rights risk assessments
• Establish systematic end-use monitoring for exported tools

As the European Commission evaluates the Dual-Use Regulation, the EU has a crucial chance to act. We set out concrete steps to close gaps and strengthen oversight so misuse cannot continue unchecked. Here are our key recommendations
December 4, 2025 at 8:18 AM
Our research, drawing from exclusive case studies in 🇫🇷, 🇳🇱, 🇩🇪 and 🇮🇹 shows the only binding EU framework on spyware exports is not keeping pace. Fragmented national approaches, opaque licensing, weak due diligence & the lack of controls on intra-EU transfers leave major loopholes vendors can exploit.
