I liked Franken, didnt love the process of wagon-circling absent an actual process for factfinding. But it undeniably paid immediate dividends, Tina Smith is also at least as good and we got Doug Jones for two years.

This. And it applies to more than just the birthright citizenship EO. The SCOTUS majority keeps allowing Trump's lawless actions to proceed during litigation, most often without any explanation, and despite hundreds of pages of factfinding and analysis in the lower courts that SCOTUS just ignores.

It’s not clear how candid Thomas has been with the Judicial Conference about what gifts he received but did not disclose, and why. One of the recurring problems at the Court has been no orderly process for any factfinding.

Some laws do get overturned where the incorrect factual basis is “this substantially affects interstate commerce”, but that’s not really relevant here.
Under rational basis the courts can’t subject legislative decision making to judicial factfinding.

Finding Vivaldi browser pretty useful so far. Tab stacks and separate workspaces are great for initial factfinding passes, and you get to save bookmarks for the proper useful stuff.

I think everyone missed the forest for the trees. The Republican challenges, recounts, and lawsuits were not about believing the 2020 election was rigged. It was a factfinding mission to figure out how to actually cheat in 2024. And everyone is afraid to even bring that up.

I am confident the judge doesn't think they are. Remember, the judge is still doing factfinding to determine whether the government violated his order. That the purpose for which any information submitted will be used, and failure to submit information is also a significant fact.
