Can we all file a class action lawsuit for emotional distress?

Does anyone know if we as the American public can have a class action lawsuit for emotional distress against Musk, an unelected private citizen?

Academia's position should be that ideas like hers aren't welcome, not because we cannot stomach divergent thought, but that ideas like hers are not new. They have been tried and tested over and over, by people just like her, an they have led to nothing we want to see more of.
