The War Powers Resolution requires the president to consult Congress before using military force. It also requires a formal explanation within 48 hours. If Congress does not authorize the action, it must end within 60 days.

When Obama used military force in places like Libya or against ISIS, there were always legal memos, briefings, and reports to Congress.

In Syria, after Assad used chemical weapons, Obama asked Congress for authorization before launching a strike, and when it became clear Congress wouldn’t support it, he respected the coequal branch and held off.

Libya was admittedly more controversial. Obama didn’t request a vote, but he filed reports and argued that the operation didn’t meet the legal definition of hostilities. That argument was challenged but at least it existed.

Trump cited the 2001 authorization meant for al Qaeda, but Iran is not al Qaeda. Iran had nothing to do with 9/11. There is no legitimate legal argument to support this move.

The Trump administration said there was an imminent threat. But they haven’t released enough evidence to back that up. Not even close.

Congress has the sole power to declare war. That is not a suggestion. It is the law. No president is above it.

And Trump ignored it.
