As always, not a lawyer, but one thing that leaps out at me about how things are going down in the courts right now is that the US court system is not designed to be responsive to a crisis like this one. A crisis like this one is not what it's FOR.

I admire Dr. Snyder and use his work in a talk I'm giving tomorrow. But I sincerely wish people on the left would stop using "affirmative action" or "DEI" as metaphors for unearned. This helps the bad guys by reinforcing an association between ameliorative policy and a supposed lack of merit.
Current American foreign policy is about draining power from the US and its allies, thereby creating atmospherics in which Donald Trump feels good and Elon Musk converts lost state capacity into personal profit. The weakness, in other words, is the point.

Some higher ed organizations who are loudly circling the wagons against federal funding cuts were oddly silent or circumspect about the earlier attacks on CRT and DEI.

I wish there was a better understanding that these attacks are coming because we failed to repel those.
