The now withdrawn EHRC Interim Update attempted to persuade employers to introduce a bathroom ban – excluding trans people from gendered facilities, whether or not the provider wanted to be inclusive. These judgements demonstrate that the EHRC interpretation was flawed.

Equally, today’s tribunal outcome ruled that the For Women Scotland Supreme Court decision “did not result in it being inherently unlawful for a trans female…to be given permission to use a female changing room at work.”

The judgement last week made it clear that allowing trans people to use toilets that align with their gender creates an inclusive workplace environment where “all employees felt respected, valued and supported.”

This week two legal judgements, concerning employers based in Scotland, have shown that employers are not obliged to exclude trans people from facilities that align with their gender.

This government needs urgently to rectify the situation before more beloved charities and national institutions are forced into applying discriminatory policies which go against their values. This is harming Britain's institutions greatly at a time when they're already stretched to breaking point.

This is mere cruelty to exclude trans people from doing the things they love with the people who love them. This is the outcome of the EHRC's decision to propose a blanket ban on trans inclusion in private as well as public organisations.

Our thoughts are with the people who may be outed by their exclusion, or lose access to their vital social groups and support networks at a time when those are more important than ever. Government must be held responsible for the long-lasting damage they are doing to a generation of LGBTQ+ people.

This government has allowed the EHRC to impose the most extreme interpretation of the supreme court ruling on the country and upend equalities law to exclude trans people from civil society. This is costly and unworkable for most charities who cannot afford to fight off vexatious claims.

If these changes must be forced on organisations, then it's clear this is the result of a handful of extremists imposing their views on groups which have been very happily trans inclusive for many years if not decades.

In the past 48 hours both Girl Guiding and the Women’s Institute (WI) have announced changed membership policies. After seeking legal advice, they felt left with no option but to exclude trans girls and women from membership.
