Flip it. Kimball tells the world Trump is the Greatest President Ever. Carr says “re-broadcast that message”. It’s State Action directed at content.

The State Actor tells the affiliates what their FCC-regulated Parent should do — suspend or Fire Kimball. They ban him from the public airways in response to that pressure. All based on the CONTENT of his speech, content that rubs the State Actor the wrong way.

Respectfully…the merger is the coercsion. You are correct about who the FCC licenses. Affiliates, not networks. But the FCC must approve the merger — publicly announced merger. They need State Action for the merger — FCC approval.

2/2 He is a State Actor. His words are State Action. He cannot change the State Actor nature of his acts by using indirect means. If this is wholly private parties (Kimball, Disney, Nexstar, Sinclair) acting — no State Actors or Actions — it is not First Amendment territory. W/ Respect. Thanks!

Glad to engage in a civil debate. My point is that Brendon Carr cannot by threat to FCC licensees accomplish through third parties — Sinclair and Nexstar — what he could not accomplish directly through legal action. He could not preempt Kimball’s future shows (Prior Restraint) directly. 1/2

You are assuming— incorrectly — that the FCC Chairman’s pressure was not the reason for Sinclair and Nextstar’s decision. If Carr kept his mouth shut you would be right. But you are wrong, on the facts and the law.

Don’t let up. These FCC License holders have an obligation to act “in the public interest.” Not Broadcasting violates the First Amendment — it is “Prior Restraint” of speech. The US Supreme Court has said Prior Restraint of Speech is UNCONSTITUTIONAL!
