There are plenty of things the founders didn't intend, we have one of the shortest written constitutions in effect. But you can't prosecute someone for an offense they have been pardoned of, the prosecution would immediately be struck by the courts.

As a legal aid attorney, I feel perfectly comfortable judging attorneys for who the choose to represent, and even who their firm chooses to represent. They always have a choice, they can always take a different job, but prefer the big paycheck.
