If self-harm is a violation of the terms of service then the bot encouraged the user not to comply with the terms of service, and in this specific case there was a failure to implement appropriate user safety guardrails. IANAL but I think this is a compelling argument to close this loophole. #OpenAI
OpenAI says they aren't liable for the suicide of a user their chat bot urged to kill himself because suicide is a violation of the TOS
Additionally, OpenAI argues its not liable because Raine, by using ChatGPT for self-harm, broke its terms of service
