The hearing in our judicial review challenge to the EHRC's (now withdrawn) Interim Guidance has finished. Judgment will follow later. No indication given as to when but he's usually pretty efficient and I would be surprised if we didn't get a judgment before Christmas.

Mr Cross is absolutely on fire today. 🔥 I like how his arguments are steering us towards a declaration of incompatibility. He even went so far as to usurp the minister’s authority and presented a justification for limiting human rights.

So, the EHRC has effectively become the State now, has it?
Yes, they made up their mind at the last minute and went all in, and now Tom Cross KC is on fire.
So EHRC are fully doubling down in their defence that trans inclusive facilities are unlawful? I assumed they'd dance around the reasonable aim and proportionate tests more.

23/ This serves as the starting point for understanding why the guidance is unlawful. The three individual claimants can now only use toilets corresponding to the opposite of their lived gender, or the disabled toilets. It is entirely unsurprising this is both direct and indirect discrimination.

Deb Cohen - while working at Newsnight to push her anti-trans ideological agenda - was also an editor of the British Medical Association (BMA) magazine, the BMJ - using her privileged position to platform transphobic talking points to give credibility.

She then reported on those points as facts! 😣

Nothing like a costly, peformative, ineffective measure that completely ignores the real problem, because tackling UK transphobia would require accepting that bigoted, corrupted politics and the UK media are the real problem faced by trans kids & adults in the UK.
