In fairness I think his point is that the judge was effectively requiring payments that could never be retrieved despite a dispute whether they legally *had* to be made. But it is such a dumb sentence for a senior judge to write. (And dumb to say the legal duty to pay them was in real doubt anyway)

It is really important, and my challenge to journalists and academics and so on in general is to do this, to point out how completely and utterly out of kilter the UK's idea of "local" government is with international norms. Local government on these islands is an embarrassing legal fiction.
