That right there is an implied waiver of privilege, on the record, no less. The judge already knows what the redacted portions of former counsel’s declarations say. It would seem that paragraph 5 is contradicted by the redacted text.

The judge clearly has some things to say about Rudy’s declaration. It’s serious enough he’s making the lawyers work on the Saturday before Christmas.
