I agree. I've been reading much of the analysis by respected legal experts. He could certainly have a go in Florida I guess. What we need most at this juncture is a robust defence of BBC independence by the UK Government & a commitment to long term funding

Poor judgement about the Trump material was an open goal. The best way to respond probably would be to apologise & pay what similar media organisations have paid c£20m. Then go on to the offensive. Sack Gibb & get back to the standards of journalism lost around 2016. Speak the truth unto nations.

apparently he proposes to sue in Florida where I imagine the law is more likely to be favourable to him. Legal experts in the UK suggest that the actual payment after a grovelling apology might be in the region of £20m. They will pay up because they are as you say.

Why can't Labour stand up for the BBC, remove Gibb and tell Trump if he sues, every possible piece of evidence about 6 January 2021 will be placed before an English court. I guess he won't try a US court because of the 1st Amendment. Don't back down any further.
