The allegation is that the teacher’s comment violated the student’s political speech. A public school teacher is a “state actor,” who has an affirmative duty under 1A not to violate free speech. So not about the teacher’s rights but about the teacher’s failure to uphold the duty to the student.

I had a similar question:

“… the school district violated her right to express her political views,” the ACLU said in a statement. “These actions have created an atmosphere of intimidation that has made D.K. and her classmates fearful of exercising their rights.”
