To grant an extension the president must certify there is substantial progress towards a divesture. He can't do that in good faith, so his executive order would break the law.

It sort of does, but Trump could not invoke it in good faith. If the president certifies there is substantial progress towards a qualified divestiture—there isn't—he can give a one-time 90-day extension of the ban.
