It’s pretty concerning the court took this case, it’s clear cut precedent that a defense doesn’t get you federal jurisdiction even when based on the constitution or federal law.

The idea there was still cargo accessible sure seems fishy as does the idea they had the ability to call anyone.

They are trying to shift the justification from killing the survivors to sinking the boat. Without seeing the footage it’s hard to know what the state of the wreckage was, but hard to envision how the boat wouldn’t be in pieces after a strike.
