More & different problems arise where the claimant is represented by solicitors, since the solicitors may be acting without authority and thus in breach of warranty. See my earlier article (2024) 140 LQR 250 on the termination of authority in supervening mental incapacity situations!

are null and void (so says the claimant). Here the claimant had represented himself in the earlier proceedings in question - they were against the Financial Ombudsman Service. CA decided claimant did have capacity. Some discussion of CPR r 21.3 and its effect. (cont'd)
