The second big thing that makes this worthless, maybe even optically, is the universal carve-out for amicus submissions.

Basically, a Justices' spouse, child, or mom could file an amicus brief in a case---either as the party or the lawyer---and it is never a basis for disqualification.

And, of course, only the individual justice decides whether or not to recuse themselves or remain on the case invoking the rule.

There is also nothing in these rules or commentary that requires the Justice to acknowledge when the Rule of Necessity has been invoked to keep them on the case.

There are two big things that make it an optics-only move.

The biggest is the express inclusion of an extremely broad understanding of the Rule of Necessity; one which expressly overrides disqualification.
