If you think the courts should fix everything, then yes, I can see how you can arrive at the conclusion that nothing can be done. But it is also true that the view that I presented here might not carry the day in the courts.

...to judge the elections, qualifications, and returns of its members under Article I, Sec 5. But importantly the Court is not saying that these aspects of Art I, Sec 5 are justiciable, just that Congress cannot exercise its authority in a way that violates other parts of the Constitution. (2/3)

I certainly think its possible. Powell is based on this idea that Congress is violating one part of the Constitution (the Qualifications Clause) in how it has exercised its authority under another part of the Constitution that courts generally treat as nonjusticiable (1/2)

I had to bring my marriage license when my 16 year old daughter went to get her driver's license because her birth certificate had my maiden name rather than my married name. I had to dig up my marriage license in the year of our Lord 2025 even though I have been divorced for years now.
