Proud that AZ Democratic legislators walked out of the joint legislative session today as ICE Director Homan spoke, in order to highlight the people who are being disappeared without due process and often without any criminal history.

"All is lost" narratives are popular because people generally do not want to take action. Taking action is tiring so if all is lost, you are off the hook. Nothing is more seductive than not having to do anything.

I'll be blunt; if we're wrong and they overturn birthright citizenship then my biggest fear is that we're on the path to a new civil war. After all, that's what happened with Dred Scott 1.0, and this would be Dred Scott 2.0.
I don’t necessarily disagree with this prediction, but I do think it would be helpful for people if litigators and legal scholars wrote about what happens if they’re wrong and the court does rule in the administration’s favor
To give some sense of why I am so confident about this, I have talked to MANY other litigators on these issues, some of the top people in the country, and my views are almost universally held. The broad consensus among pretty much everyone I know is that the Court will rule against him on this.

To say this for the 50th time, for anyone who doesn't know:

Three young conservative lawyers were part of the GOP "Florida recount" team that led to GWB becoming president, via Bush-v-Gore.

They were: John Roberts. Brett Kavanaugh. Amy Coney Barrett.

Small world.

Yes, the Supreme Court has failed to protect us from Trump. But it’s worse than that: The Supreme Court is imposing its own fascism. It invented presidential immunity. It has gutted the Voting Rights Act, passed by a bipartisan Congress. It’s as bad as Trump, and moving in the same direction.

The Cruelty Is the Point (™Adam Serwer).

How can it *possibly* bother a grown-up person that someone else has chosen a different path?

I can understand, though I strongly disagree with, anti-abortion rights fervor. But this? How does it hurt anyone else? Jeesh.

You could write this. Or you could write: “That notion, which has been the rule in nearly every country in the Western Hemisphere for over a century, is grounded in the language of the 14th Amendment.”

All how you choose to frame it.

NEW info on shipwreck attack. It gets worse.

The 2 survivors climbed atop wreckage and waved to overhead.

"Some of the people viewing the video thought ... could have been an attempt to surrender"

Others "said the most logical explanation was ... signaling for a rescue."

these clowns are REALLY going to say that Texas’s map - which targeted majority minority districts - was NOT discrimination on the basis of race.

But they’ll say Louisiana’s map - drawn to comply with the Voting Rights Act and give Black voters representation- DID discriminate on the basis of race

TLDR: SCOTUS rules, 6-3, that racial gerrymandering is totally okay when Republicans do it. And if a district court suggests otherwise, they were dumb and too mean to Republicans (specifically “not presuming their good faith”).

The result is that our society is full of hype men gaining ever more power, manipulating us in ever-more-insidious ways, and tearing down our democracy's ability to combat the hype cycle.

This ability is called financial regulation and it is super boring, is the problem.

Last week, ICE arrested and separated a father and son after a routine check-in. Six-year-old Yuanxin had just enrolled in the first grade at an elementary school in Astoria. Now he's in custody, alone. ICE won't say where. This cruelty serves no one. It must end.

National Guard aren’t ICE or Border Patrol. They didn’t sign up looking to harass and repress people. They’re volunteers, part time, in case of emergency. They didn’t ask for this.

West Virginia National Guard shouldn’t have been deployed in Washington DC.

Victims of the shooter and the president.

Democrats should ask: when residential natural gas prices are at their highest ever, why are we exporting a record amount? Why not use it to make energy more affordable here?

The GOP has no answer for this; it contradicts everything they claim they're doing.
