Seems like she's being used as the fall-person to avoid more sweeping contempt charges.

Even DoJ's own filing says that Noem was advised by others, including Emil Bove. The advise was probably "What are they going to do, charge us with contempt?"
Excerpt from DOJ filing: Deputy Attorney General Todd Blanche and Principal Associate Deputy Attorney General Emil Bove provided DHS with legal advice regarding the Court's order as to flights that had left the United States before the order issues, through DHS Acting General Counsel Joseph Mazzara. Mr. Mazzara then conveyd that legal advice, as well as his own legal advice, to Secretary of Homeland Security, Kristi Noem. After receiving that legal advice, Secretary Noem directed that the AEA detainees who had been removed from the United States before the Court's order could be transferred to the custody of El Salvador. As explained below, that decision was lawful and was consistent with a reasonable interpretation of the Court's order.

From this transcript, you would think he was simply blind. Video of a guy standing still, with no federal officers nearby, and Bovino says he can't tell whether the guy was in contact with any federal officer.
