In a case about helmet designs, Cardinal Motors v. H&H Sports Protection, the 2nd Circuit helpfully clarified the pleading standard under trade dress law. To survive a motion to dismiss, a plaintiff must clearly specify what it seeks to protect under the “articulation requirement." #trademarklaw

The 2nd Circuit issued a Summary Order vacating dismissal of Wonderful Pistachios' trade dress case. The decision seems odd in running through a likelihood of confusion analysis factor by factor as if on the merits rather than simply considering whether the claim was properly pled. #trademarklaw
