The 2nd Circuit issued a Summary Order vacating dismissal of Wonderful Pistachios' trade dress case. The decision seems odd in running through a likelihood of confusion analysis factor by factor as if on the merits rather than simply considering whether the claim was properly pled. #trademarklaw
