Not a criticism of this (excellent!) thread, or Casten in particular, but I do think Democrats need to start laying out clear, definitive and escalatory steps they plan to take in response if/when SCOTUS goes through with this.

A neat thing about birthright citizenship is how it tests whether a person cares at all about the Constitution. There's no argument against it, birthright citizenship is the unambitious text, the obvious intent of the drafters, and the undisputed way it was followed for the past 150+ years.
I continue to think that Matty coming out against birthright citizenship a few months ago should have been taken as a major warning sign that the group chats have already decided to surrender on this.

A lot of people on Twitter and Bluesky alike love to go "what about Sudan?" in response to pro Palestinian sentiment but in general if you're pro Palestine you're also far likelier to be anti UAE. See for example the senator below, who was the harshest critic in the Senate of both Biden and Trump.
The RSF just attacked a kindergarten, killing at least 33 children in Sudan.

Meanwhile, the Trump Admin. continues to sell arms to the UAE, who are aiding these atrocities.

You see this in how Dred Scott was nullified and defied by states, Congress, and Lincoln's administration even before the 14th Amendment. It was codifying the repudiation of Dred Scott but their position was that it had always been illegitimate and not binding.
i think to understand the meaning of the birthright citizenship clause to the framers of the 14th amendment, you have to understand significance of dred scott to the civil war republican party. dred scott wasn't just a bad ruling, it was understood as a rejection of the declaration itself.

again, the supreme court did not write the constitution (or the declaration) and—despite what you may think—they don't have the monopoly on the interpretation of those documents.

the people have a say, and if the court is out of step with the people, that's a problem for the court, not the governed
