Bottom line: Unless Sung voted in favor of en banc review, a 15-14 vote for rehearing was the best CA could get.
It's very easy to see some judges preferring not to start getting into the practice of en banc review of a ruling on a stay pending appeal of a TRO. (That is quite a can of worms.)
