November 10, 2025 at 3:52 PM
Nagu eelnevalt mainisin, soovib Euroopa Komisjon muuta GDPRi. Algselt sootivi muuta ainult andmetöötlusregistripidamise nõuet ja paari muud aspekti. Nüüd eelmine nädal aga lekkis pikk dokument Euroopa Komisjonist, kus oli väga palju muudatusi, mida võiks nimetada lausa GDPRi põhja laskmiseks.

Also, as @gateklons.bsky.social noted, the Commission is not able to go through it on its own. There shall also be opinions from the EP and the Council. But still do expect a lot of lobbying. Kinda reminds the early GDPR days (I was not involved with GDPR back then haha, but I have read about it)

Technically as far as I know, this leak came from DG Connect, not DG Just, which is mainly responsible for the GDPR. Further on, I doubt this will go through without a “fight”, both ex ante as well as ex post.

Yeah... at least we have a pending case, where one Estonian prominent businessman has a case pending against Estonia for unlawful retention of his communication data and there is a high chance that this case will not end within Estonia and it might reach either CJEU or ECHR.

As usual, I expect Max Schrems together with NOYB to take action. Max noted on LinkedIn that we can expect more statements from them tomorrow

Similarly our Supreme Court did similar ruling in 2021. However, our state has ignored both rulings.
November 9, 2025 at 8:21 PM
This would among other things be positive for Estonia as our state has ignored the judgement of the CJEU, where it ruled in 2014 (!) that obligation imposed on telecom operators to collect and store data on a mass scale violates people's fundamental rights.

*Data act entered into force last year and most provisions in September of this year. I do not understand the logic of already amending the law. The only positive development I see is the plan to draft new Data Retention Regulation.
November 9, 2025 at 8:21 PM
In other areas they create more chaos - according to the reporting of the German outlet Heise, European Commission is looking into consolidating the Open Data Directive, the Regulation on the free flow of non-personal data, the Data Governance Act and the Data Act into one amended Data Act.
