Yesterday, Judge Briones, like Judges Harvey, Brinkema, and Berton before him, ordered Cesar & Norelia released. The absurdity of the situation was not lost on him as he ended the hearing and order by noting “Let's see what court you're going to go to next.” 10/

Last week, the couple traveled to El Paso for a court hearing. At the hearing, Judge Berton ruled that they remain free until their next hearing. Yet, as they were boarding their flight home to reunite with their children, ICE detained them yet again. 9/

On Mar 28th, Judge Brinkema ordered Cesar & Norelia released after their first habeas petition hearing in Virginia, during which she told the govt their work in the case was "shoddy" and that "[they] don't have it." A statement that was later echoed by Judge Briones. 7/

On Mar 13th, the couple was ordered released by Judge Harvey, but were instead briefly detained by ICE before being released. Less than 10 days later, ICE once again unlawfully detained them and separated them from their children. 6/

This is despite the fact that both Cesar and Norelia have TPS and pending asylum applications, which means the government should not be able to detain them on the basis of their immigration status. 5/

Importantly, the judge also ordered that the govt has to give 21-day notice to anyone detained under the AEA in the Western District of Texas, that includes the right to seek judicial review and consult an attorney, and be written in a language the person understands. 2/
