This is part of the statement I've seen. Like, Brown has had gender neutral bathrooms for ages, and I mean with showers and such

I tend towards the idea of performative compliance on this one.
As we have for decades, Brown has agreed to abide by Title IX and NCAA eligibility rules regarding the participation of transgender athletes in intercollegiate sports. We also committed that the University will continue to provide housing and restroom access in a way that allows for gender-inclusive, women-only and men-only options. The agreement also states, "The University will not perform gender reassignment surgery or prescribe puberty blockers or hormones to any minor child for the purpose of aligning the child’s appearance with an identity that differs from his or her sex." The University will refer affected students who seek care from Student Health Services or the University Pharmacy to area specialists. The agreement does not affect medical teaching or training, and does not apply to clinical services provided by health systems that are separate entities from Brown, such as Brown University Health and Care New England. We remain fully committed to serving the health needs of all Brown students in a manner consistent with our long-established policy of nondiscrimination, which includes sex, gender identity and gender expression. The LGBTQ Center, Student Health and Wellness Services, and other offices in the Division of Campus Life, as well as the Warren Alpert Medical School, School of Public Health, the College, Graduate School, Office of Diversity and Inclusion and many other offices across campus will continue to be partners in supporting the needs of our community.

Screenshot: This is not merely discrimination in practice, but discrimination by law. Adalah have composed a database of discriminatory laws in Israel that disfavor non-Jewish Israelis. For example, the Law of Return and Absentees’ Property Law are but two examples of flagrant racism and discrimination in the Israeli legal system [You can read more about this here]. This is not some old, odd oversight, but a very deliberate part of the design of Israeli society. This is periodically reinforced whenever some Israelis petition the Supreme Court to recognize an Israeli nationality that does not discriminate based on ethnicity. A recent example of these petitions was in 2013, where the Supreme Court rejected such an idea on the grounds that it would “undermine Israel’s Jewishness“. It says quite a lot about Israel that a unifying egalitarian identity not based around ethnicity would “pose a danger to Israel’s founding principle: to be a Jewish state for the Jewish people“, as the court ruled. The fact that such discrimination is seen as a cornerstone of Israeli society only reinforces its colonial ethnocratic nature, and undermines any claims to equality among citizens. Palestinian citizens of Israel, who comprise about 19% of the population, face many forms of institutionalized discrimination. In 2018, discrimination against Palestinians was crystallized in a constitutional law which, for the first time, enshrined Israel exclusively as the “nation state of the Jewish people”. The law also promotes the building of Jewish settlements and downgrades Arabic’s status as an official language. The report documents how Palestinians are effectively blocked from leasing on 80% of Israel’s state land, as a result of racist land seizures and a web of discriminatory laws on land allocation, planning and zoning.

52. There is considerable scientific evidence demonstrating a durable biological element underlying gender identity. For example, neuroanatomy studies of brain scan patterns often align with gender identity rather than external genitalia or chromosomes.17 For example, Yokota et al reported that the shape of the corpus callosum, a structure in the brain, in transgender individuals was closer to subjects with shared gender identities than to subjects who shared the same sex designated at birth.18 Results of genetic, biologic, and neuroscience studies support the concept that gender identity is not simply a psychosocial construct, but likely reflects a complex interplay of biological, environmental, and cultural factors, which may explain why attempts to change gender identity in intersex patients to match external genitalia or chromosomes are often unsuccessful.19 Among individuals with XX chromosomes and congenital adrenal hyperplasia (CAH) there is higher exposure to androgens (masculinizing hormones) in utero that corresponds to higher rates of male gender identity compared to those who do not have similar in utero exposure to Testosterone.20 Individuals with XY chromosomes and complete androgen insensitivity have tissues that are not able to respond to Testosterone and often have female gender identity. Identical twins (twins who share the exact same genetic material) are more likely to both experience transgender identity compared to sets of fraternal twins (non-identical).

For purposes of identity documents, including passports, a person’s gender identity is the most accurate and least problematic characteristic for determining what their sex is. 43. There is a medical consensus that gender identity is innate and that efforts to change a person’s gender identity are unethical and harmful to a person’s health and well-being. 44. According to the American Medical Association, the American College of Physicians, the American Psychiatric Association, and 25 other major U.S. medical and psychological professional associations, “variations in . . . gender identity are a normal part of human development” and “research and experience shared by scholars, clinicians, and patients have shown that . . . efforts [to change someone’s gender identity have not succeeded] and are harmful.”

Worthy of note is Dr. Corathers' outline of how the EO is completely untethered to 'biological reality':
THE GOVERNMENT’S DEFINITION OF SEX IS IN CONFLICT WITH BIOLOGY 27. The Executive Order Section 2 (d) states that “’Female’ means a person belonging, at conception, to the sex that produces the large reproductive cell” and Section 2 (e) states that ”’Male’ means a person belonging, at conception, to the sex that produces the small reproductive cell”. These terms are not used in clinical medical practice or scientific discourse. 28. The Executive Order’s definition of sex is arbitrary and inconsistent with biology. Notably, the gonads that may later have capacity to produce reproductive cells are not present at conception. Impliedly, the reference to the “large reproductive cell” indicates egg or ova from an ovary and “small reproductive cell” means sperm from a testis. What is certain is that there are many individuals whose gonads are not able to produce eggs or sperm. Furthermore, sperm production, when present, is not possible until male puberty, between the ages of 9-14 years. 29. The government’s definition of sex is inaccurate, conflates sex and fertility, neglects the existence of medical conditions that result in differences in sex development, individuals who face infertility for any reason, and the interrelation between sex and gender. 30. In the United States, about 11% of women and 9% of men of reproductive age experience fertility issues.2 The government’s definition of sex that is dependent upon presence of reproductive cells is untenable given that fertility status is often not established until adulthood.

Okay! So there's been some movement in Orr v. Trump (Passports lawsuit) in the last couple days.

Most notably, a motion was filed for a preliminary injunction yesterday:
Defendants Department of State (the “Department”) and Secretary of State Marco Rubio (collectively, the “Agency Defendants”) have adopted and are currently implementing a policy to only issue passports with either female or male sex designations as determined by the definitions in Executive Order 14168, 90 Fed. Reg. 8615 (Jan. 20, 2025) § 2(d)–(e) (the “Executive Order”) and the ensuing Department directives, which turn either on whether a person “belong[ed], at conception, to the sex that produces” either “the large” or “the small reproductive cell,” or what the Agency Defendants have termed “biological sex at birth” (the “Policy”). Pursuant to 5 U.S.C. § 705, Plaintiffs Ashton Orr, Zaya Perysian, Sawyer Soe, Chastain Anderson, Drew Hall, Bella Boe, and Reid Solomon-Lane (“Plaintiffs”) respectfully request the Court stay enforcement of the Policy during the pendency of this litigation, and require the Agency Defendants to process and issue passports consistent with the Department’s policy as of January 19, 2025, including permitting (i) changes to the sex designation on passports, including allowing individuals to self-attest to what their sex is, and (ii) the use of an “X” sex designation on passports. Additionally, pursuant to Federal Rule of Civil Procedure 65(a), Plaintiffs respectfully request that the Court enjoin the Agency Defendants from enforcing the Policy and the Executive Order as applied to passports against Plaintiffs during the pendency of this litigation, and, as to Plaintiffs, require the Department to process and issue passports consistent with the Department’s policy as of January 19, 2025, and permit (i) changes to the sex designation on Plaintiffs’ passports, including allowing Plaintiffs to self-attest to what their sex is, or (ii) an “X” sex designation on any of the Plaintiffs’ passports where that is requested by the Plaintiff.

And the dude next to me says, "hey i'm not doing anything, i'm a paying customer." and the bartender reaches under the counter for a bat or something and says, "out. now." and the dude leaves, kind of yelling. And he was dressed in a punk uniform, I noticed Anyway, I asked what that was about and the bartender was like, "you didn't see his vest but it was all nazi shit. Iron crosses and stuff. You get to recognize them." And i was like, ohok and he continues. "you have to nip it in the bud immediately. These guys come in and it's always a nice, polite one. And you serve them because you don't want to cause a scene. And then they become a regular and after awhile they bring a friend. And that dude is cool too. And then THEY bring friends and the friends bring friends and they stop being cool and then you realize, oh shit, this is a Nazi bar now. And it's too late because they're entrenched and if you try to kick them out, they cause a PROBLEM. So you have to shut them down. And i was like, 'oh damn.' and he said "yeah, you have to ignore their reasonable arguments because their end goal is to be terrible, awful people." And then he went back to ignoring me.
