The facts for Cox looked bad. Clement, for Sony, made reference three times to what he called the "F the DMCA" email sent by one employee (which did not, in fact, say "F"). 1/

It’s been in the pipeline for a minute, but the short version is: Cox lost the DMCA safe harbor for (more or less) refusing to disconnect accounts. The question then becomes, ok, they don’t have the safe harbor—but even without it, are they liable?
Why did this even make it to SCOTUS? What's the procedural history here?

If I had to lay down money, I'd say that they'll say "failure to meet the safe harbor doesn't automatically create liability (because this part is explicitly in the statute), and secondary liability CAN attach, under this brand new 10 part test"
